A Walmart employee hurt her shoulder at work.  Her workers compensation claim was denied citing she had pre-existing arthritis as seen on MRI and then terminated from Walmart claiming it does not have work within her permanent physical restrictions.
Walmart employee hires Attorney Lisa Pierobon Mays to pursue her claim against Walmart.  Attorney Pierobon Mays files for benefits to include permanent disability, lost time benefits, medical expense reimbursement, and retraining.
A few days before the hearing with the Department of Workforce Development, Walmart ultimately agrees to pay the Walmart employee for her permanent disability, reimburse the private short term disability carrier for 100% lost time benefits, and all medical expense and mileage.  In addition, injured worker will return to school in Fall 2012 at which time Walmart will be responsible for payment of her wages for 80 weeks while in school and all allowable retraining expenses associated with her course of study, such as tuition, books, mileage, meal stipends, and parking.

Pierobon Mays Wins Over $120K for Client

January 2012 - Attorney Lisa Pierobon Mays wins over $120,000.00 for her client at hearing against Walmart.   

The case involved an injured worker who suffered a mid-back injury moving a box of product off a shelf in 2009 while working at Walmart.  Worker underwent a fusion surgery with excellent result and no lasting pain symptoms or need for medication.  Walmart refused the claim citing it was a pre-existing injury per MRI finding.

Attorney Pierobon Mays filed for a hearing with the Department of Workforce Development claiming, among other things, over one year of lost wages, 10% permanent disability to the back, medical bills, and mileage.

At hearing, Walmart called it's orthopedic doctor and a Walmart area manager to testify.  Both were rigorously cross-examined by Attorney Pierobon Mays.  The Department found injured worker's orthopedist more credible and deemed the injury, while pre-existing, aggravated beyond its normal progression due to the lifting of the box at work.

Attorney Pierobon Mays looks forward to her next hearing against Walmart involving another injured worker in March 2012.

2010 Victory at Hearing

Attorney Lisa Pierobon Mays recently succeeded at hearing to recover all benefits for her client.  Client (referred to as D.D.) is a State of Wisconsin employee who slipped and fell at work in 2009 injuring her left knee and requiring surgery.  The State denied D.D. all of her benefits, claiming the symptoms and surgery were not work-related, but rather pre-existing because of an earlier surgery in 1985.

Attorney Pierobon Mays established at hearing that, despite a prior surgery to the same knee, the symptoms and subsequent medical treatment was caused by the 2009 fall at work.  The State was ordered to pay D.D. all benefits which included permanent disability, lost time from work, medical expenses, and medical mileage.
