A Walmart employee hurt her shoulder at work. Her workers compensation claim was denied citing she had pre-existing arthritis as seen on MRI and then terminated from Walmart claiming it does not have work within her permanent physical restrictions.
Walmart employee hires Attorney Lisa Pierobon Mays to pursue her claim against Walmart. Attorney Pierobon Mays files for benefits to include permanent disability, lost time benefits, medical expense reimbursement, and retraining.
A few days before the hearing with the Department of Workforce Development, Walmart ultimately agrees to pay the Walmart employee for her permanent disability, reimburse the private short term disability carrier for 100% lost time benefits, and all medical expense and mileage. In addition, injured worker will return to school in Fall 2012 at which time Walmart will be responsible for payment of her wages for 80 weeks while in school and all allowable retraining expenses associated with her course of study, such as tuition, books, mileage, meal stipends, and parking.
